A. Administrative / Registration Fees

All administrative or registration fees are non-refundable, as they cover processing, onboarding, and resource allocation costs.

B. Full Course Payment Refunds

Refunds may be considered under the following conditions:

• A written refund request is submitted at least 7 days before the program start date.

• The participant has not accessed course materials or attended any class session.

If approved:

• A 70% refund will be issued.

• 30% shall be retained as administrative and processing costs.

C. Cancellation after Course Commencement

Once the program has commenced, no refunds shall be granted, no refunds will be granted once the participant has:

• • Attended a session,

  • Accessed training materials,

  • Downloaded course resources.

However, participants may request:

• Transfer of enrollment to the next cohort (subject to availability), OR

• Credit toward another M&K Data Consult program within 6 months.

Such alternatives are goodwill accommodations and do not constitute a legal obligation.

2. Corporate Training & Consulting Services

For organizations engaging M&K Data Consult:

• Deposits are non-refundable once project planning has commenced.

• If cancellation occurs:

  • 14 days before project start: 50% refund of deposit.

  • Less than 14 days before start: No refund.

• If M&K Data Consult cancels the engagement, a full refund will be issued within fourteen (14) business days..

3. Digital Products (E-books, Templates, Recorded Courses)

Due to the nature of digital products:

• All digital product sales are final and non-refundable.

• Refunds will only be considered if:

  • The file is corrupted, OR

  • The product was not delivered after successful payment.

Refund Processing Timeline

• Approved refunds will be processed within seven (7) to fourteen (14) business days.

• Refunds will be issued via the original payment method.

• Any transaction fees charged by payment gateways may be deducted.

Force Majeure

The Company Merit Kel Data Consult shall not be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to:

• Natural disasters

• Government restrictions

• Public health emergencies

• Internet infrastructure disruptions

In such cases, the Company may reschedule services without refund liability.

 

Limitation Of Liability

The Company shall not be liable for:

• Indirect or consequential losses;

• Loss of profits or business opportunities;

• Personal circumstances preventing attendance.

• We are not responsible for technical disruptions beyond our control.

Liability, where applicable, shall not exceed the amount paid for the specific service in question.

Dispute Resolution

Any dispute arising under this Policy shall first be resolved amicably through written communication.

Where resolution fails, disputes shall be subject to the jurisdiction of the courts of the Republic of Ghana.

Intellectual Property Rights

All materials provided by M&K Data Consult, including but not limited to:

• Training manuals

• Slide decks

• Videos

• Templates

• Frameworks

• Proprietary methodologies

are the exclusive intellectual property of M&K Data Consult.

You may not:

• Reproduce

• Distribute

• Resell

• Share login access

• Modify or republish materials

without prior written consent.

Unauthorized use may result in legal action.

User Conduct

You agree not to:

• Share access credentials

• Record live sessions without authorization

• Disrupt training sessions

• Engage in harassment or misconduct

• Use materials for competing commercial purposes

We reserve the right to terminate access without refund for violations.

Minimum Enrollment & Cohort Confirmation Policy

Minimum Enrollment Requirement

To ensure effective learning outcomes, interactive participation, and operational viability, M&K Data Consult sets minimum enrollment thresholds for all training programs as follows:

• Online (Virtual) Training Programs: Minimum of ten (10) confirmed participants

• In-Person (Physical) Training Programs: Minimum of twenty (20) confirmed participants

A participant shall be considered “confirmed” only upon receipt of payment in accordance with the agreed payment terms.

Failure to Meet Minimum Enrollment

Where the minimum enrollment threshold is not met before the scheduled commencement date:

• The Company reserves the right to postpone, reschedule, or merge the cohort.

• Participants shall be notified at least three (3) days prior to the original start date.

This shall not constitute breach of contract but shall be treated as a conditional commencement provision.

Participant Options Where Minimum Is Not Met

In the event that a training session is postponed due to insufficient enrollment, participants who have made payment may choose one of the following options:

Option A: Carry Forward (Default Option)

Participants may elect to transfer their enrollment to the next available cohort of the same program at no additional cost.

The full amount paid shall be credited toward the rescheduled session.

Option B: Refund

Participants may request a refund of the amount paid.

Where a refund is requested:

• Administrative or transaction processing fees may be deducted.

• Refunds shall be processed within seven (7) to fourteen (14) business days.

• Refunds shall be made via the original payment method.

No Additional Liability

M&K Data Consult shall not be liable for:

• Personal expenses incurred by participants (e.g., transportation, accommodation, leave from work);

• Indirect or consequential losses resulting from postponement.

Acceptance of Condition

By enrolling in any training program, participants acknowledge and agree that commencement of the program is conditional upon meeting the stated minimum enrollment requirement.
